DAMAGES FOR BREACHING FIRE AND SAFETY REGULATIONS

January 20 2004. Both employers and employees are now able to claim damages for breaches of workplace safety and fire regulations, under new regulations which amended the Fire Precautions (Workplace) Regulations 1997 and the Management of Health and Safety at Work Regulations 1999. The changes took effect on 27 October 2003 and from this date, employees will be able to claim damages in civil actions as a result of breaches by the employer of both sets of regulations, while employers will be able to take action against employees for breaches of the 1999 regulations. Amendments are being made to the 1997 regulations to clarify enforcement responsibilities.
